Terms Of Use

 Publisher agrees not to accept demand from Viant on any property that:

o   Contains unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, profane, racist, sexually explicit or indecent material;

o   Encourages, promotes, solicits, or commits conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any local, state, national or international law;

o   Violates, plagiarizes, or infringes the rights of third parties including, without limitation, copyright (including offering pirated computer programs or links to such programs, information used to circumvent manufacturer-installed copy-protect devices, including serial registration numbers for software programs, or any type of hacker or cracker utilities), patent, trademark, trade secret or other intellectual property, rights of privacy or publicity or any other proprietary right;

o   Promotes physical harm or injury against any group or individual;

o   Promotes or solicits participation in multi-level marketing or pyramid schemes;

o   Exploits children under eighteen (18) years of age;

o   Constitutes requests for money, petitions for signature, or chain letters;

o   Contains a virus or other harmful component;

o   Constitutes or contains false or misleading indications of origin or statements of fact;

o   Collects, uses and/or discloses personally identifiable information in violation of i) the privacy policy of Viant, and/or ii) applicable local, state, national or international law; or 

o   Are otherwise reasonably determined by Viant to be inappropriate.

 

Publisher’s properties will each contain a conspicuous link to a privacy policy that (A) is in compliance with all applicable laws, rules, regulations, and self-regulatory principles; (B) adequately sets forth the collection and use of data gathered in connection with such site, including with respect to collection of data by third parties to deliver advertisements of interest to end users; and (C) describes how end users may learn about the choices offered in connection with the use of their data and opt out of such use, including a link to http://www.aboutads.info/choices/, http://www.networkadvertising.org/managing/opt_out.asp, or the appropriate link for the applicable country if such use occurs outside of the United States.
